1. General terms and conditions

The purpose of these GTC is to define the conditions under whichthe sale of products offered by Nut’z (hereinafter the “seller”) and any person of legal age visiting or making a purchase from the online shop www.nutz.pet (hereinafter the “customer” or the “buyer”). However, any minor with the permission of a legal representative may use our online shop and our services. The Nut’z online shop is operated by HAIRBORIST S.P.R.L., registered with the Crossroads Bank for Enterprises under BE0898695003, whose registered office is located at Bonestraat 102 B-8760 Meulebeke Belgium

1.2 The customer refers to the person who has placed and paid for the order, as defined in the GTC.

1.3 Any order placed by a customer through the Nut’z online shop automatically leads to the creation of a contract between the customer and HAIRBORIST S.P.R.L.. This implies the formal acceptance of the GTC.

1.4 These GTC are binding.

1.5 These GTC apply, without restriction or reserve, to all sales of products offered by Nut’z on its online shop www.nutz.pet.

1.6 That said, the fact that the buyer orders a product offered for sale on the Nut’z online shop implies full acceptance of these GTCs, which the buyer acknowledges having read prior to ordering.

1.7 These GTCs may be modified at any time, without prior notice. The modifications of the latter will come into effect at the opening of the online shop and only for sales made subsequently. In case of modification, the GTC applicable to the customer’s order are those that were online and that the customer accepted on the day of placing the order.

3. Prices

3.1 The prices indicated, in euro, on the online shop www.nutz.pet, are valid at the time of the placement of the order by the customer.

3.2 Prices may be changed by Nut’z at any time.

3.3 The sale prices of products on the online shop www.nutz.pet do not include shipping costs, which may be charged in addition to the price of the products purchased.

3.4 The shipping costs will be indicated before the order is placed by the customer, depending on the delivery method chosen by the customer and the amount of the order.

3.5 The sale prices of the products on the online shop www.nutz.pet include the value added tax (VAT) applicable on the day of the order.

3.6 Any change in the applicable VAT rate will be automatically reflected in the price of the products sold by Nut’z on the online shop.

3.7 During certain periods of the year, the customer may benefit from certain promotional offers.

3.8 These offers will be announced on the online shop but also on our various social networks: Facebook, Instagram and Linkedin.

3.9 These offers will be valid while stocks last, during the indicated period.

4. Products

4.1 The products offered for sale on the online shop each have a description indicating their essential characteristics.

4.2 Nut’z provides the customer with the information necessary for the proper use of the products.

4.3 The information provided about essential oils is no medical information. Any therapeutic use of essential oils must be supervised by a qualified health professional. In the event of animal pathology, this does not replace the obligation to consult a veterinarian.

4.4 Advice and guidance are given to the customer for information purposes only.

4.5 Nut’z cannot be held responsible for any damage caused by misuse of the products sold on its online shop or by failure to observe the precautions for use.

5. Availability

5.1 The products sold and dispatched by Nut’z on the online shop are offered within the limits of available stock.

5.2 In the event of unavailability of the product ordered, Nut’z will immediately inform the buyer and may offer him a product of equivalent quality and price, use a voucher for the amount of the order for any future order or the customer may also wait for a restocking.

6. Order

6.1 Orders are placed through the Nut’z online shop: www.nutz.pet. The contractual information is presented in English.

6.2 To place an order, the customer must select the item(s) he/she wishes to order and add them to the basket. At any time, the customer can consult this basket and modify it if necessary. If the customer already has a customer account, Nut’z will invite the customer to log in (using the customer’s email address and password).

6.3 If the buyer is a new member, he can create his account by entering his personal data (first name, last name, email address). This account will make it easier to connect the buyer during future orders.

6.4 In order to finalise and validate any order, the customer must fill out the requested delivery data and choose the delivery and payment method.

6.5 During the ordering process, the customer declares that he/she has read and accepted the GTC.

6.6 The data recorded by Nut’z constitutes proof of all transactions between Nut’z and its customers. Only these data are authentic in the event of a dispute between Nut’z and its customers.

6.7 After validating and registering the customer’s order, Nut’z will send the customer a summary by email. This summary will be sent to the email address that the customer has previously entered when registering.

6.8 This email shall summarise all the elements of the customer’s order and the amount invoiced.

6.9 The order cannot be modified, and for any requests relating to the partial or complete modification of the order, the customer must contact the seller.

6.10 The customer should then contact customer service via the “Contact us” section, or directly by e-mail to the following address: [email protected]. Nut’z strongly recommends that customers contact this service before the order is shipped.

7. Payment

7.1 The payment of the customer’s purchases on the online shop is only made in euro (€).

7.2 Payment can be made by credit card: Visa, MasterCard and American Express.

7.3 Nut’z also offers its customers two other options for paying for their orders: iDEAL and Bancontact.

7.4 No bank details are kept by Nut’z.

8. Delivery and receipt

8.1 Nut’z works in partnership with Bpost, for the shipment of all its products on sale on its online shop www.nutz.pet.

8.2 Shipping costs depend on the amount of the order, the weight, the dimensions, the final delivery destination and the delivery method.

8.3 The shipping costs are calculated in the shopping cart and/or before the payment of the order.

8.4 The cost of transport may be modified without notice by Nut’z according to the costs invoiced by its service provider.

8.5 Nut’z invites its customers, when ordering, to provide all the information necessary for a correct delivery of their package.

8.6 When your parcel leaves, a confirmation email containing the delivery tracking number will be sent to the customer.

8.7 Nut’z asks the customer to consult his/her email regularly in order to be kept informed.

9. Right of withdrawal

9.1 Conditions for withdrawal

9.1.1 The customer has a right of withdrawal of fourteen (14) days, starting from the day of the receipt of the order.

9.1.2 The customer has this right to withdraw without necessarily giving a reason.

9.1.3 To exercise this right, the customer must notify the customer service by a written statement specifying his name, first name, email, address, order number and date.

9.2 Refunds

9.2.1 In the event of withdrawal by the customer, Nut’z will refund the payments received from the customer, as soon as the products have been received and checked.

9.2.2 If the customer withdraws only a part of the order, Nut’z will refund the value of the returned products.

9.2.3 The refund will be made by the same means of payment that the customer used for the order.

9.3 Return of products

9.3.1 The customer must return the products no later than fourteen (14) days after having communicated his decision to withdraw.

9.3.2 The right of withdrawal is only possible if the product has not been used. Returned products must be in their original condition and complete. A product that has been opened or damaged by the customer will not be accepted by Nut’z.

This can be accompanied by the return form that can be downloaded here or the following information can be written on plain paper: name, first name, email, address, etc.

9.3.4 The customer shall bear the costs of returning the complete order or products.

11. Intellectual property

11.1 The online shop www.nutz.pet as well as any software used in connection with it may contain confidential information, as well as data protected by intellectual property law.

11.2 Unless otherwise stated, the intellectual property rights on the documents, all content in the online shop and each of the elements contributing to the brand (images, illustrations, sounds, texts, graphic elements, etc.), including software, databases and newsletters, are the exclusive property of Nut’z (hereinafter “content”).

11.3 Nut’z does not grant any licence or any right other than that of consulting the online shop.

11.4 The reproduction of all or part of the content is authorised solely for personal and private use. Any reproduction or use for other purposes is strictly prohibited. It is also forbidden to modify, copy, create a derivative work, assemble, decompile (with the exception of cases provided by law), sell, assign, sub-license or transfer anything relating to the content.

11.5 It is prohibited to modify all or part of the content, including the software, or to use modified versions of the software to gain unauthorised access to the service, and to access the www.nutz.pet online shop by any means other than through the interface that is provided to the visitor by Nut’z.

11.6 Nut’z reserves the right to claim damages in the event of infringement and more generally of its intellectual property rights.

11.7 All other trademarks or logos appearing on the www.nutzpetcare.com online shop are the property of Nut’z or its partners. Any use of these trademarks, logos or any other content is subject to the authorisation of Nut’z or the holder of the intellectual property rights.

12. Garantuees

12.1 The customer is guaranteed that the Nut’z products are qualitative.

12.2 If the defect is proven, Nut’z will exchange, advise a similar product, or refund the defective or non-compliant products.

13. Responsabilities

13.1 Nut’z cannot be held responsible for damage of any kind, whether material, immaterial or physical, resulting from improper use of its products.

14. Disputes

14.1 This contract is subject to Belgian law.

14.2 In the event of a dispute, the customer shall first contact the seller via the customer service department to obtain an amicable solution. Complaints or disputes will always be received with attentive benevolence and good faith will always be presumed in the person who takes the trouble to explain the situation.

14.3 In the event of difficulties with the application of this contract, the client has the possibility, before taking any legal action, to seek an amicable solution, with the help of a professional association specialised in this sector, a consumer association or any other advice of his choice.

14.4 In the event of a written complaint that is not resolved by our customer service, the European Commission has set up an online dispute resolution platform accessible via the following link:https://ec.europa.eu/consumers/odr/main/?event=main.home2.show

14.5 In the absence of an amicable agreement between the parties, the dispute will be submitted to the Court of Justice in Courtai, unless otherwise provided by law.
